Con la llegada de la reforma de la nueva, en México está prohibido el outsourcing o subcontratación de personal, ya que, la idea es evitar abusos y violación de los derechos de los trabajadores y a su vez evitar la evasión en el reparto de utilidades e impuestos.
Quizá sea un tema que ya hayas escuchado mucho o quizá no, pero es importante dejar claro que dentro de las principales cuestiones que conforman la reforma de outsourcing se encuentra la prohibición de la subcontratación de personal y únicamente se permiten los casos de subcontratación de servicios especializados que no formen parte de la actividad preponderante de la empresa.
Para llevar a cabo cualquier tipo de subcontratación de servicios especializados tendrá que realizarse un contrato dentro del cual se incluya el número de trabajadores que participarán y la empresa prestadora de servicios tendrá que estar registrada en el padrón de la STPS. Para poder registrarse será necesario estar al corriente con obligaciones fiscales y temas de seguridad social.
A raíz de la reforma se dice que solamente entre el 30% y 40% de las personas que trabajan bajo un esquema de outsourcing podrán ser contratadas por la empresa en la que laboran.
Es muy importante que tomes en cuenta las leyes que regulan el tema de outsourcing, porque si cuentas con este en tu planta deberás realizar diversos cambios para asegurarte de operar bajo el marco de la ley. Es decir, debes tener claro bajo qué condiciones o alternativas podrás contratar servicios.
Con la llegada de la reforma deberás:
- Asegurarte de que los proveedores de servicio cuenten con su registro REPSE el cual demuestra que su carácter es especializado. Para corroborar si se encuentra en el padrón de servicios especializados puedes buscarlo en el catálogo de registros REPSE por medio de su RFC o razón social.
- Reforzar la selección, asegurándote que los servicios que contratas para tu planta no tengan impedimentos de acuerdo con el objeto social de tu empresa.
